Cherry FLFM is owned and operated by Cherry FLFM Inc.

Cherry FLFM values your privacy and the protection of your personal data. This privacy policy describes what information we collect from you, how we collect it, how we use it, how we obtain your consent, how long we keep it in our databases and, if necessary, with whom we share it.

By using the platform, you are accepting the practices described in this privacy policy. Your use of the platform is also subject to our terms of service. In this privacy policy, the word “platform” refers to the Cherry FLFM mobile application and the Cherry FLFM website together, unless referred to individually in the document, “we”, “us”, “our” and “Cherry FLFM” refers to Cherry FLFM and “you” and “user” refers to you, the user of Cherry FLFM.

This privacy policy may change from time to time. Your continued use of the platform after we make changes to this privacy policy will be deemed acceptance of those changes, so please check this policy periodically for updates. This privacy policy has been developed and is maintained in accordance with all applicable national and international privacy and data protection laws and regulations and specifically, the Personal Information Protection and Electronic Documents Act (PIPEDA – Canadian regulations), the California Consumer Privacy Act of 2018 (CCPA), the Data Protection Act 2018 (UK regulations) and the General Data Protection Regulation (GDPR – European regulations). 

1. WHO WE ARE

Based in Vancouver, British Columbia, Canada, Cherry FLFM Inc. is a company dedicated to providing an inclusive platform through its mobile app, Cherry FLFM. This app is specifically designed to help sapphic people connect and form friendships or romantic relationships.

The term “Sapphic” refers to a female-aligned person who is attracted to women or female-related genders and identities (source: LGBTQIA+ Wiki). By using this term, we want to emphasize that Cherry FLFM is an inclusive space, which will always welcome trans and non-binary people.

3. HOW WE OBTAIN CONSENT

When you visit the website, use the platform, register as a user and create a profile, use the functionalities available on the platform, use the chat systems, provide or share content with other users, purchase a subscription or buy premium functionalities, and contact us through our contact details, you consent to our collection, storage and use of your information under the terms set out in this privacy policy.

4. TYPES OF INFORMATION COLLECTED

The information we collect from our users helps us to continually improve the user experience on the platform. These are the types of information we collect:

Information you provide to us. You provide information when you visit the website, use the platform, register as a user and create a profile, use the features available on the platform, use the chat systems, provide or share content with other users, purchase a subscription or buy premium features, and contact us through our contact information. As a result of those actions, you may provide us with the following information:

• Full name
• Date of birth
• Profile picture
• Email
• Phone number
• User content
• Any additional information relating to you that you provide to us directly or indirectly through your use of the platform.

Account information: When you create an account on our platform, you provide us with basic information needed to set up your account, such as your phone number, email address, and date of birth. This information is essential to identify you as a user, ensure the security of your account, and provide you with a personalized experience.

Profile information: When completing your profile, you can share additional information about yourself, such as your gender, interests, personal preferences, and approximate location. In addition, you have the option to include data that may be considered sensitive in certain countries, such as your pronouns, sexual orientation, relationship type (e.g., monogamous, non-monogamous or polyamorous), and political beliefs. This additional data helps us improve your experience on the platform, allowing you to connect more meaningfully with other users who share similar interests or characteristics.

It is important to note that some of this data, such as data related to sexual orientation or pronouns, may be considered sensitive under the laws of certain countries. By providing us with this information, you explicitly consent to its collection, processing, and use in accordance with our Privacy Policy. We always treat this data with the utmost confidentiality and ensure that we comply with applicable data protection laws.

Verification Data: You may participate in our Photo and ID Verification, which involves collecting face geometry data, which may be considered biometric data in some jurisdictions. We compare this with a copy of your government-issued photo ID to help verify your identity and the information on your profile. We do not store these photos. 

Usage Data (website): As you browse our website, certain usage data is automatically collected. These include technical information such as the IP address of your device, the type and version of your browser, the specific pages you visit on our website, the date and time of your access, the amount of time you spend on those pages, and other diagnostically relevant data.

In the case of access via mobile devices, we also collect information specific to these devices. This may include, but is not limited to, the type of mobile device used, its unique identifier, the IP address of the device, the mobile operating system, and the type of mobile browser, along with other identifiers and diagnostic data.

In addition, we collect information that your browser automatically provides each time you visit our website or access our website using a mobile device.

Usage Data (mobile application): Cherry FLFM automatically collects certain types of information during users’ use of the application. This collection includes technical data such as device type, operating system, device settings, application usage, and interaction preferences. This information is essential to improve the functionality and performance of the application, as well as to customize the user experience and ensure system compatibility. All data collected is handled in accordance with our privacy policy, ensuring its protection and confidentiality. 

User’s location (GPS): By using Cherry FLFM, the user agrees that the platform may access and use the GPS feature of the device to provide location-based functionality. This includes the ability to display profiles of other users who are near the user’s location. Location information is used exclusively to enhance the user experience and provide more relevant interactions within the Cherry FLFM community.

User privacy is a priority, and location information is handled with strict confidentiality. This data will not be shared with third parties without the user’s explicit consent, unless required by law. While the user can disable the GPS function from the device settings, this may limit some functionalities of the platform.

By enabling and using the GPS feature on Cherry FLFM, the user acknowledges and consents to the use of their location to enhance connectivity and interaction with other users within the platform.

User Content: Cherry FLFM collects, processes, and stores user content, which includes content and information provided through our platform, including user profile content and chat system messages, solely for the provision and enhancement of functionality available on the platform. User content will be stored in our cloud storage services. We are committed to maintaining the confidentiality and security of this content and information, and will not share it with unauthorized third parties, unless required by law or for the operation of the platform.

Third-party platforms: You have the option to share information with us through your accounts on other platforms, such as Facebook, Instagram, or Spotify. This may happen when you choose to create or log in to your account using these platforms or when you choose to upload content from them, such as photos, playlists, or other personal data.

When you connect through these platforms, we may receive additional information, such as your username, profile picture, contacts, music preferences, or interests, depending on the permissions you have granted on those platforms. This integration not only facilitates the registration and login process, but also allows you to personalize your profile on our platform and enrich your experience by sharing aspects of your digital identity.

By linking your social media account with our service, you consent to the collection and processing of this information in accordance with our Privacy Policy. It is important that you review the privacy settings of external platforms to understand what data they are sharing and how you can manage it. We are committed to treating this data with the utmost care, always respecting your rights and complying with applicable data protection regulations.

Payment information (in-app subscriptions): Users may pay for in-app subscriptions through the Apple App Store and Google Play. User payment information, including credit card or other payment method information, will be processed directly by these third-party services and not by our platform. Each of these providers handles payment information in accordance with their own privacy and security policies. We encourage users to review these policies to understand how these third-party providers handle your personal and payment information. Our application does not store or have access to users’ financial data.

Contact information: We may access some personal information about the user, such as name and email address, when the user or any third party communicates with us through our contact information. Personal information provided through our contact information is not stored on any Cherry FLFM server and will be stored on the respective server of our email service.

5. HOW LONG WE KEEP YOUR DATA

Personal data provided by users through the platform will be retained for the time necessary to provide the functionalities available on the platform, to fulfil the legitimate purposes described in section 5 of this policy, or until the user closes the user account or requests the deletion of their data. Cherry FLFM may retain personal data for a longer period provided that the user has consented to such processing, as long as such consent is not withdrawn. In addition, Cherry FLFM may be obliged to retain personal data for a longer period provided that this is required for compliance with a legal obligation or by order of an authority. Once the retention period has expired, the personal data will be deleted. Therefore, the right of access, the right of deletion, the right of rectification, and the right to data portability cannot be asserted after the retention period has expired.

6. HOW WE USE YOUR INFORMATION (LEGITIMATE PURPOSES)

In general, we use the data we collect primarily to provide, maintain, protect, and improve our platform and to properly deliver the functionalities available on the platform. We use the data collected through our platform as described below:

To provide our service:

• Creating and maintaining your account and profile on our service
• Operating and maintaining the various features on our service
• Recommending other members to you and recommending you to them
• Organizing sweepstakes and contests
• Responding to your requests and questions 
• Monitoring the well functioning of our service and troubleshooting and fixing issues as needed

To enable your purchases on our service:

• Processing payments
• Offering discounts and promotions, customizing prices

To keep you and other users safe: 

• Preventing, detecting, and fighting against violations of our Terms and Conditions, fraud, and other illegal or unauthorized activities 
• Developing and improving tools to prevent, detect, and fight against violations of our Terms, fraud, and other illegal or unauthorized activities
• Preventing recurrences, notably by preventing individuals who violate our Terms and Conditions from creating a new account
• Letting individuals who submit a report know what we’ve done about it
• Verifying your identity
• Securing payments and fighting against financial fraud

• Performing and measuring the effectiveness of advertising campaigns run on our service
• Performing and measuring the effectiveness of marketing campaigns promoting our own service on third-party platforms

• Analyzing how our service is used
• Reviewing interactions with customer care teams to improve service quality
• Developing and improving new features and services and testing them out

To comply with applicable law, establish, exercise and defend legal claims & rights, including:

• Processing and responding to requests related to users’ privacy rights.
• Preserving data to comply – and evidence compliance – with applicable law
• Supporting investigations and defending potential or ongoing litigation, regulatory action or dispute

7. HOW WE SHARE INFORMATION

Information about our customers is an important part of our business, and we are not in the business of selling it to others. We share customer information only as described below.

Data shared with other users: First, you share information with other users when you voluntarily disclose data through the platform’s functionalities, such as in your public profile. Second, if someone files a complaint involving you (for example, for allegedly violating our terms and conditions), we may notify the complainant of the actions taken, if any, as a result of their complaint. The same is true when you file a report involving another user. Finally, if you use the “Send to a friend” function, you can share other users’ profiles, and they, in turn, can share yours with people outside the platform.

Third-Party Service Providers. We use third party services to perform certain functions on our platform. Some of these functions and services include: hosting the app in the app stores (App Store and Google Play), payment processing (App Store and Google Play), data storage services, sending emails, and performing tracking and analytics functions on the platform.

These third-party services and tools may have access to personal information needed to perform their functions, but may not use that information for other purposes. Information shared with these third-party services will be treated and stored in accordance with their respective privacy policies and our privacy policy. 

Newsletter and email marketing: By providing us with your email address, you consent and agree that we may send you marketing content and newsletters, notifications, and information related to our platforms. Therefore, your email address may be shared with third party bulk email services for the sole and exclusive purpose of sending you relevant communications. If you wish to stop receiving communications from Cherry FLFM, you can unsubscribe at any time by using the “unsubscribe” option available in the same emails or by sending your request through our contact information. 

Business Transfers. In the event Cherry FLFM creates, merges with, or is acquired by another entity, your information will likely be transferred. Cherry FLFM will send you an email or post a prominent notice on our platform before your information becomes subject to another privacy policy.

Protection of Cherry FLFM and Others. We release personal information when we believe release is appropriate to comply with the law, to enforce or apply our terms and conditions and other agreements, or to protect the rights, property, or safety of Cherry FLFM, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Anonymous Information. Cherry FLFM uses anonymous browsing information collected automatically by our servers primarily to help us administer and improve the platform. We may also use aggregated anonymous information to provide information about the platform to potential business partners and other unaffiliated entities. This information is not personally identifiable.

8. DATA BREACH NOTIFICATIONS

In the event of a security breach that compromises the confidentiality of the personal data of our users, Cherry FLFM undertakes to notify those affected in a timely manner. This notification will be made by any available electronic means. We will take all reasonable measures to protect the information and remedy any situation that compromises the security of your data.

9. INTERNATIONAL DATA TRANSFER

By using our platform, you agree that your personal data may be transferred and processed outside your home country, where data protection legislation may differ from that of your country. This is because we may use storage services that may have servers located outside your country. Cherry FLFM is committed to taking the necessary steps to ensure that your data is treated in accordance with applicable privacy protection rules and is adequately protected during any international transfer.

10. PROTECTION OF YOUR INFORMATION

We grant access to your personal information only to those outside persons or services that have a legitimate need to know it and in accordance with our privacy policy. We adhere to industry-recognized security standards to protect your personal information, both during transmission and in storage. However, it is important to note that no method of transmission over the Internet or electronic storage is foolproof and 100% secure. Therefore, while we at Cherry FLFM strive to implement commercially viable data protection methods, we cannot ensure absolute security of your personal information. We undertake not to sell, distribute, or transfer your personal data to unauthorized third parties, unless we have your explicit consent or are required by law to do so.

11. RIGHTS 

Users who provide information through our platform, as data subjects, have the right to access, rectify, download, or delete their information, as well as to restrict and oppose certain processing of their information. While some of these rights apply generally, others only apply in certain limited circumstances. These rights are described below:

• Access and portability: to access and know what information is stored on our servers, you can send us your request through our contact information.
• Rectification, restriction, limitation and deletion: You may also rectify, restrict, limit, or delete much of your information.
• Right to be informed: Users of our platform will be informed, upon request, about what data we collect, how it is used, how long it is kept, and whether it is shared with third parties.
• Object: Where we process your data based on our legitimate interests, as explained above, or in the public interest, you may object to this processing in certain circumstances. In such cases, we will stop processing your information unless we have legitimate grounds to continue processing it or where necessary for legal reasons.
• Withdraw consent: Where you have previously given your consent, for example to allow us to process and store your personal information, you have the right to withdraw your consent to the processing and storage of your information at any time. For example, you can withdraw your consent by updating your settings. In certain cases, we may continue to process your information after you have withdrawn your consent if we have a lawful basis for doing so or if your withdrawal of consent was limited to certain processing activities.
• Complaint: If you wish to lodge a complaint about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority. Users may exercise all of these rights by contacting us via the contact information or the Contact Us page.
• Rights related to automated decision-making, including profiling: Users may request that we provide them with a copy of the automated processing activities we conduct if they believe that data is being unlawfully processed.

Users or holders of personal data provided through the platform may exercise these rights over their personal data at any time and without limitation by sending their request through our contact information. The request to exercise their rights will be attended and answered within a maximum period of 10 working days. 

12. RIGHT OF EDITING AND DELETION

We are committed to ensuring that our users maintain full control over their data. We therefore grant users the explicit right to modify or delete any information they have provided to the platform.

Users can exercise this right directly through their user account, by facilitating the editing or deletion of data such as their personal information, profile information, services, etc. In the event that certain requests cannot be handled through the user’s account, users may contact us through our contact information to make the necessary edits or deletions.

Our approach is designed to ensure that users have constant and effective control over their data, allowing them to manage their information in a way that protects their privacy and autonomy.

13. PROTECTION OF CHILDREN’S ONLINE PRIVACY 

Cherry FLFM is an adult platform that offers content and functionalities exclusively for persons of legal age. In no event is its content or services directed to persons under the age of 18 or under the age of 21 in some jurisdictions from which the platform is accessed. Access to our platform is restricted to persons over the age of 18 or 21, depending on applicable age of majority legislation, so we only collect and process information from persons over the age of majority. 

14. THIRD PARTIES

Except as expressly included in this privacy policy, this document addresses only the use and disclosure of information Cherry FLFM collects from you. If you disclose your information to third parties, whether other users or affiliates of Cherry FLFM, different rules may apply to their use or disclosure of the information you disclose to them. Cherry FLFM does not control the privacy policies of third parties, and you are subject to the privacy policies of such third parties where applicable. Cherry FLFM is not responsible for the privacy or security practices of other third-party platforms or services, including those linked to or from the Cherry FLFM platform. Please review the privacy policies of any third-party services you access through the Cherry FLFM platform.

15. CHANGES TO PRIVACY POLICY

We reserve the right to change our privacy policy at any time. Changes will be promptly notified to our users and posted on the platform. Your continued use of the platform and our services following these changes implies your acceptance of the changes.
